A legal battle in Kentucky could become a major test of how much authority local governments have to slow or block AI data center projects.

Kentucky Industrial Alliance has filed two lawsuits against the Kentucky town of Cave City after officials approved a one-year moratorium on new data centers shortly after the company submitted plans for its proposed Cave Point Commerce Center.

The $4.8 billion project would create a 1.2-gigawatt AI data center facility on roughly 600 acres near the entrance to Mammoth Cave National Park, with the developer ultimately controlling about 1,000 acres in the area.

The lawsuits challenge both the temporary development pause and the city’s earlier annexation of the property, with the company arguing that the land should not fall under municipal jurisdiction.

The case is a reversal of the norm: it is far more common for local groups to use legal action to block data center construction. In any case, the significance of the dispute extends beyond this project, highlighting the raging national debate over how communities should balance the expansion of AI infrastructure against environmental and quality-of-life concerns.

Environmental Concerns

The proposed campus is designed to support AI and cloud workloads that require enormous computing capacity and electrical power. Plans call for ten buildings of approximately 200,000 square feet each, creating one of Kentucky’s largest proposed AI infrastructure developments. At full build-out, the facility would consume approximately 1.2 gigawatts of electricity, requiring major new power infrastructure.

Kentucky Industrial Alliance proposes generating roughly half of the site’s power from an adjacent off-grid natural gas-fired power plant, while the remaining 600 megawatts would be supplied by Farmers Rural Electric Cooperative through East Kentucky Power Cooperative. The scale of the project also would require additional transmission infrastructure and substations, another source of concern for local residents.

Water consumption is a key element of the debate. To limit water usage, the developer says its facility would use a closed-loop, non-evaporative cooling system with no continuous discharge, allowing spent water to be transported off-site rather than released into local waterways. According to the developer, the campus would consume approximately 300,000 gallons of water per day, comparable to a single office building despite its computing capacity.

Opponents argue that the project’s location presents unusual environmental challenges. Mammoth Cave sits above an extensive network of underground caves and waterways where groundwater and surface ecosystems are closely connected. Residents say that potential groundwater impacts need additional study before development proceeds.

The company maintains that the project would generate economic benefits, including approximately 360 direct and indirect jobs along with millions of dollars in annual tax revenue. It argues that the project deserves consideration based on technical and economic merits rather than a temporary development ban.

The Kentucky dispute will certainly be watched as cities and states across the US resist the build-out of AI infrastructure. Several states and municipalities are evaluating moratoriums or stricter approval processes as they weigh the long-term implications of supporting AI’s rapid expansion.
